Default Another interesting Question?

Bob was attending a seminar at the Red Lion Inn. He took a swim in the pool, and after the swim he went to purchase a soda from a Pepsi vending machine. He was still wearing his wet swimming trunks.
He inserted his money. An electrical current passed through his body. A machine technician found that the power cord’s metal conducting waves were exposed.
Bob became impotent from the electrical shock.
Can Bob sue? Who should he sue?
On what legal issues?
Who will win?

I think Bob only can sue for Specific Performance of the Contract on the basis of deficiency in business services. Bcoz the power cord's metal conducting waves were exposed, and it is the duty of Red Lion Inn staff to care of proper lighting in the premises.
So this can be a sound legal basis. Its just my opinion.

I would say he would sue the Red Lion Inn under public liability.

He should have been careful.Wetness is friend to current.Even if he sue redlion he cannot win legally.

Sounds like a clear breach of Health and Safety in allowing a machine to be live.

But I'm not a lawyer...

All electrical appliances should be checked when fitted and then annually, the register will need to be checked to see if there has been a breach. The question is very clever as someone could have messed with the cable the day before.

Also was the man breaking the establishment rules by leaving the swimming pool area in trunks. This could lead to a wet floor, causing another hazard.

Bob can sue the machine owners if it can be proved it was not fitted right.

Bob could also sue the Red lion if after the machine was fitted it was not serviced regularly and entered in the electrical safety register.

However was Bob breaking any rules himself, leaving the pool area, this could only be determined by inspecting the premises.

To many imponderables to decided

Just my opinion.
