hi all (hopefully this is an appropriate thread!)
With regards to looming changes to sub contract laws, i was just looking for some direction with legalities of the way our company 'employs' our sub contract workers. we are installers of double glazing products, windows, doors, conservatories etc. (dont worry we're not your sterio-typical double glazing company!! we are a friendly family business!! )Currently we have two crews of fitters that install the products we sell. The fitting crews use all their own equiptment (tools etc.) & we supply the products required to complete an installation (sealants, fixings etc.) we also supply them with vehicles (which we maintain/tax/insure etc) - which they contribute £x per week to 'hire'. At the point of sale it is explained to our customers that they pay the fitters seperately and we guarantee the product & installation. So it is really a question of do we currently 'employ' them (I would argue not as they are paid by the customer not us?!), what do we need to do regarding upcoming changes (if anything?!) what effect might putting them on our books have on our profits/their take home pay? Any advice would be gratefully appreciated. Regards Michael |

So it is really a question of do we currently 'employ' them (I would argue not as they are paid by the customer not us?!), what do we need to do regarding upcoming changes

That's a very good question - it sounds like a more complicated process than I'm used to, and I'd hate to hear you fall foul of IR35 if it applied.
