Hi Guys,
Quick question. I have had ideas to start a swap site however am not sure of the legal implications. The idea is that you sway cds and dvd's within groups you create online. Its really an online library service allowing you to leend and borrow your personal collections. I would not be making money from the swapping but does a consumer have the legal right to lend an item they have bought? Thoughts would be welcome Jonnyd8 |

Hm...good point. I think aside from resell rights issues, you should also be aware that you'll probably end up with the counterfeiters using such a site if they can - swap those originals for a few well-boxed pirate copies. Definitely something you'll need a solicitor to really advise on, in my opinion.

I'm not entirely sure if it is legal. I have seen notices on rental DVDs/Library books that say no lending and or public viewing. But maybe if you stick to the idea of swapping instead of lending it could work well.

I believe that if you can put restrictions on listening and watching and keep on the site without making copying possible then that should be legal. There are a love of online music radio stations that always have the option of buying a legal copy if they really want to have it for themselves, that could be a good option as well.
