Why not? Rules are rules after all, if someone doesn't want to take the risk of a search engine penalty they would have designed the site without any of these issues. They could just as easily get hit for spamming by the search engines themselves.

Practices like that increase costs and undermine effectiveness of EVERYBODY'S promo efforts, so actually they could be interpreted as action against your own business, as well as the common good.

In all honesty, I think people would be better investing their time making their own sites as best as possible, rather than investing time in trying to have other sites removed.
The former is a marketing strategy, the latter is not.
